This Refund Policy governs subscription payments for Kontab ("the Service"), operated by Solèy Technologies Ltd., a company incorporated in Saint Lucia with its principal place of business at Cas En Bas, Gros Islet, Saint Lucia.
By subscribing to the Service, users agree to the terms set out below.
1. Nature of the Service
Kontab is a subscription-based software service provided on a recurring billing basis. Access to the Service is granted for the duration of the applicable billing period (monthly or annual), subject to payment of the relevant subscription fees.
2. Free trial
Where offered, Kontab provides a free trial period of 30 days from the date of account creation to allow users to evaluate the Service prior to purchasing a paid plan.
No payment method is required to start the trial, and no subscription charges are applied during the trial solely because you created an account.
The free trial does not automatically convert to a paid subscription. To access a paid plan after your trial, you must select a plan and complete checkout. If you do not upgrade, your account moves to the free tier (Free Legacy) at trial end.
Paid charges apply only after you explicitly choose a paid plan and complete the applicable checkout or confirmation step presented at that time.
3. Refunds — what we offer
Nothing in this Policy limits mandatory statutory rights that apply to you. Where those rights apply, they prevail.
Depending on how you purchased, refund and buyer-protection processes may be handled by our payment provider or reseller (for example, Paddle, when acting as merchant of record) and/or reviewed by Kontab support. We will correct billing errors and duplicate charges when verified.
If you believe you were charged in error, contact us so we can review your case and, where appropriate, coordinate with the payment provider.
Outside mandatory rights and the corrections above, subscription fees are generally earned for the billing period you selected once that period has begun. That typically means:
- Partial use of a billing period does not automatically entitle you to a full or partial refund
- Failure to cancel before a renewal may result in renewal charges in line with your checkout and the provider's terms
- Non-use of the Service during an active subscription period does not automatically entitle you to a refund
4. Cancellation and renewals
Cancelling a paid subscription stops future renewals. It is separate from whether a past payment is refundable. In ordinary cases, cancellation is intended to take effect at the end of your current billing period, so you retain paid access until that time, subject to your payment provider's buyer terms and applicable law.
Where you cancel, you remain responsible for charges already incurred for the current period unless a refund is required by applicable law or approved under this Policy or your payment provider's process.
5. When we may issue refunds or adjustments
Refunds or account adjustments may be considered by Kontab support and/or processed through your payment provider, including where Paddle or another provider manages the buyer relationship. Examples include:
- A billing error or duplicate charge
- A material defect in the Service that prevents reasonable use and cannot be resolved within 5 business days of the defect being reported to support
- Other exceptional circumstances reviewed on a case-by-case basis
Approval or denial of a refund may depend on mandatory rights, the provider's policies, and our assessment of the facts — it is not a single "sole discretion" rule that overrides Paddle or legal obligations where they apply.
Where a refund is granted, it will be processed using the original payment method where possible, or otherwise as required by the payment provider.
6. Service issues and support
Users experiencing issues with the Service are encouraged to contact support promptly so that the matter can be investigated and resolved. We aim to respond to all billing and support enquiries within 2 business days.
Refunds may be declined where a reasonable opportunity to resolve the issue has not been provided, subject to your statutory rights and payment-provider rules.
7. Cancelling your subscription (access and data)
Subscriptions may be cancelled through the flows available in your account or billing portal (including any provider-managed portal where applicable).
Upon cancellation of a paid subscription:
- Paid access to the Service ordinarily continues until the end of the current billing period
- No further renewal charges should apply after cancellation takes effect under the provider's rules
- A refund for the unused portion of the current billing period is not guaranteed and is assessed under this Policy, mandatory rights, and provider processes
- Your business data will remain accessible in read-only mode for 30 days following the end of the billing period, after which it may be deleted in accordance with our Privacy Policy. Some records may be retained longer where the law requires (for example, tax or accounting retention).
8. Chargebacks and payment disputes
Kontab may investigate disputed accounts and may limit or suspend access where fraud, abuse, or non-payment is reasonably suspected, while preserving your legal rights, card-network chargeback rights where they apply, and any buyer protections offered by Paddle or your payment provider.
We encourage you to contact support at support@kontab.net first so billing concerns can be resolved quickly. We aim to resolve billing concerns within 2 business days where reasonably practicable.
9. Changes to this Policy
Solèy Technologies Ltd. reserves the right to modify this Refund Policy at any time. Changes will be communicated to subscribers via email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Policy.
10. Compliance with applicable law
Nothing in this Policy limits any rights that may be available to consumers under applicable laws of Saint Lucia, including rights relating to unfair practices, misrepresentation, or failure of the Service to perform as reasonably expected.
11. Governing law
This Refund Policy is governed by the laws of Saint Lucia, without regard to conflict-of-law principles that would apply another jurisdiction's laws, except where mandatory consumer protections in your location cannot be waived.
